Temporary employment is not clearly defined in the North Dakota Century Code. However, the following conditions generally characterize temporary employment with the state:

  • Temporary employees do not occupy regularly-funded, classified positions.
  • Temporary employees perform work that usually is limited in duration; hours may vary considerably.
  • Temporary employees who work at least 20 hours per week for 20 or more weeks per year and are at least 18 years of age may purchase life insurance at their own expense. 
  • Temporary, non-seasonal employees who are reasonably expected to work at least 30 hours per week or 130 hours per month will be offered health insurance. The employer cannot charge eligible, temporary employees a premium that exceeds the affordability rules defined by the federal Affordable Care Act for single coverage. If applicable, eligible, temporary employees may purchase coverage for dependents at their own expense or their employer may pay the premium subject to budget authority. HRMS recommends speaking with the agency budget director for fiscal guidance. 
  • Temporary employees do not earn annual or sick leave benefits. However, if they become regular status employees, and there was no break in service beyond one year, they are given credit for their temporary service for the purpose of determining the annual leave accrual rate.
  • Temporary employment is at will, not requiring cause for dismissal.

Recommendations

  • The appointing authority should advise a new temporary employee of the anticipated length of employment.
